More than a third of ads do not comply with rent controls in Paris and Seine-Saint-Denis

37% of advertisements in Paris and Seine-Saint-Denis exceed the rent ceiling, according to the association CLCV (Consumum, housing and living environment). That’s more than last year.

This is a step backwards for tenants’ rights. In 2024, 37% of property ads for rent do not comply with rent controls in Paris and Seine-Saint-Denis, according to a study by the consumer association CLCV carried out by 1,800 advertisers. In 2023, the rate of illegal advertising was 31%.

According to the association, in Paris, 29% of advertisements are not compliant. The situation is much worse in Seine-Saint-Denis, where a rate of non-compliance reaches 47%.

“It is not tolerable that many years after its implementation, rent control is still not applied massively,” the CLCV is outraged.

The association notes better respect for rent control for unfurnished rental housing (30% non-compliance compared to 44% for furnished rentals). Likewise, professionals respect this system more than individuals, since 30% and 43% respectively offer rents that exceed the authorized maximum.

For illegal ads, the tenant pays on average an additional monthly cost of almost 159 euros, or 1,908 euros per year. And some owners do not hesitate to go much further. Thus, the association cites the example of a 20 m² studio rented for 1,300 euros when it could not exceed 642.50 euros, a difference of 7,890 euros per year.

Despite the institution of a reporting platform from the city of Paris, the CLCV “complains that there are no systematic sanctions in case of violation of rent controls”. The association also judges that “in view of the abuses observed, it is essential to perpetuate once and for all rent control”.

Study carried out from advertisements published on the Internet between December 2023 and August 2024. In total, 1,800 advertisements were taken into account, 1,000 for Paris, 400 for Plaine Commune and 400 for Est Ensemble. These ads were randomly selected from the following 7 sites: bienici.com, century21.com, citya.com, foncia.com, leboncoin.fr, pap.fr, and seloger.com.
